A coibição da alienação parental sob a perspectiva da guarda compartilhada

Resumo

RESUMO: O Presente estudo pretendeu examinar a coibição da alienação parental sob a perspectiva da guarda compartilhada dando ênfase aos conflitos inerentes a alienação que surgem logo após a separação conjugal dos genitores, a proposta deste artigo cientifico é trazer um estudo sobre a base familiar formada no novo contexto demonstrando a dificuldade da criança em se readaptar, descrevendo o papel da guarda compartilhada como instrumento de proteção à criança e adolescente inibindo a alienação parental. O objetivo geral deste artigo foi descrever as relações conflituosas em que o menor é exposto. E, no decorrer deste estudo, apresentar a conceituação da guarda e suas modalidades no ordenamento jurídico brasileiro, ponderando a alienação parental e como os alienadores provocam disfunções psicológicas no menor. A metodologia utilizada nesta pesquisa é a dedutiva e pesquisa teórica sobre o tema abordado.

ABSTRACT: The present study intended to examine the restraint of parental alienation under and from the perspective of shared custody, emphasizing the conflicts inherent in alienation that arise shortly after the conjugal separation of parents, the purpose of this scientific article is to bring a study on the family base formed in the new context demonstrating the child's difficulty in readjusting, describing the role of shared custody as an instrument to protect children and adolescents by inhibiting parental alienation. The general objective of this article is to describe the conflicting relationships in which the minor is exposed, presenting specifically during the course of this study the concept of custody and its modalities in the Brazilian legal system, considering parental alienation and how the alienators cause psychological dysfunctions in the minor. The methodology used in this research and the deductive and theoretical research on the topic addressed.
